Absolutely not. While I have never returned or even considered doing so when having a bad Port experience from a bottle purchased at retail, it is my belief that within the confines of purchasing ANY wine off of a restaurant wine list, they accept all responsibility for bad bottles ... not the customer. There's a reason we pay 3-4x the retail price in a restaurant and that also includes them absorbing these risks (as just one of the reasons for higher pricing). This comes from someone who worked in all levels of foodservice management the majority of my adult life.
